Creighton Law Professor Published in Cornell International Law Journal
An article by Creighton University law professor and international law specialist Michael Kelly has been published in Issue 3, Volume 38 of the Cornell International Law Journal.
"Milosevic and Hussein on Trial: The Tricky Nature of Proving Genocide Against Saddam Hussein Before the Iraqi Special Tribunal" explores the challenges of successfully bringing genocide charges against Saddam Hussein for gassing Iraq's Kurdish population and decimating its Shi'ite Marsh Arab population in the 1980s while Iraq was a war with Iran.
Defenses to these charges, the dynamics of conducting a criminal prosecution in Baghdad, and the factual basis of the underlying crimes are also discussed in depth.
Professor Kelly is author of the book Nowhere to Hide: Defeat of the Sovereign Immunity Defense for Crimes of Genocide & the Trials of Slobodan Milosevic and Saddam Hussein and co-author of the book Equal Justice in the Balance: Americas Legal Responses to the Emerging Terrorist Threat.
